2. How to Submit a Formal DMCA Takedown Notice

If you are a copyright owner or an agent authorized to act on behalf of one, you may submit a written copyright infringement notification. Pursuant to 17 U.S.C. § 512(c)(3), your notice must include ALL of the following six elements:

1. Physical or Electronic Signature: A physical or digital signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the Copyrighted Work: A clear description of the original copyrighted work you claim has been infringed (for example, a link to the original work or copyright registration number).
3. Identification of the Infringing Material: Specific identification of the material on JoinDiscordServer.info that you claim is infringing, including the exact URL(s) so our team can locate it.
4. Your Contact Information: Information reasonably sufficient to permit us to contact you, including your legal name, physical mailing address, telephone number, and valid email address.
5. Good Faith Statement: A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
6. Statement Under Penalty of Perjury: A statement made under penalty of perjury that the information in your notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Counter-Notification Procedure

If you believe that your community listing, server avatar, or bot overview was removed or disabled as a result of a mistake or misidentification, you may submit a formal counter-notification pursuant to 17 U.S.C. § 512(g)(3).

To be effective, a counter-notification must be in writing sent to dmca@joindiscordserver.com and must contain:

• Your physical or electronic signature.
• Identification of the material that has been removed or disabled, and the URL where it appeared prior to removal.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your legal name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate legal authorities.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the complaining party does not file a court action within 10 to 14 business days, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable intellectual property laws, JoinDiscordServer.info maintains a strict repeat infringer policy. We will permanently delist and terminate directory access for community owners or bot developers who are repeatedly found to infringe the copyrights of others.

6. Legal Warning Concerning False Claims

Under Title 17, United States Code, Section 512(f), any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed by mistake, may be held liable for damages, including attorney fees incurred by the alleged infringer or website operator.
